Open Enrollment 2026: A Brief for Legal Professionals
Open enrollment is the one stretch of the calendar in which every counsel in private practice may switch, upgrade, or originate health coverage without justifying a qualifying life event. Miss it and the alternatives — short-term plans, COBRA, or waiting eleven months for the next window — are uniformly worse than a fifteen-minute review in mid-November.

The dates of record.
What is materially different for 2026.

Enhanced subsidies remain in effect.
Premium-tax-credit enhancements first enacted under the American Rescue Plan and extended through subsequent legislation continue to apply to plan year 2026. Many attorney households above the historical 400% FPL ceiling remain eligible for meaningful subsidy. Do not assume you have aged out without running the calculation.
Network and formulary changes are universal.
Every carrier files revised provider networks and drug formularies before plan year. The plan you used in 2025 may have dropped your primary-care provider or tiered up a medication. This is the single most common reason we re-shop counsel who were 'happy' with their incumbent plan.
Four pre-filing checks.
- Project 2026 MAGI conservatively — average prior two years if practice is steady, lean toward the lower year if not
- Reconfirm every household physician, specialist, and pharmacy is in-network for the plan under consideration
- Match every household medication against the formulary tier on the candidate plan
- Confirm whether any anticipated 2026 event — birth, surgery, orthodontia — should shift the analysis toward a richer tier
